Tax
Tax law becomes decisive at the point where the commercial logic of a transaction is turned into legal form. Two different structures that produce the same commercial result can differ seriously in their tax burden; that difference can be managed at the structuring stage, not after the transaction is complete. We therefore treat tax advice not as work that runs alongside the transaction, but as part of the transaction’s design. The second dimension of work in this field is the dispute. A tax audit, an assessment and court proceedings rest on their own procedural rules, their own time limits, and a largely settled body of case law. By working on both the structuring side and the dispute side, the team can assess from the outset how a choice will be received at the audit stage.

How we work
On tax files it is often unavoidable to work together with certified public accountants and independent auditors. We prefer to separate the roles at the outset: the calculation and filing side is the accountant’s; the legal basis of the obligation and the dispute strategy are ours. A clear separation prevents the two sides from giving explanations that contradict each other at the audit stage.
Time limits in tax disputes are strict and cannot be made good once missed. On the first day of the file we draw up a calendar that includes the periods for application, settlement and bringing an action, and we run the process against that calendar.
