Law No. 7589: Judicial Reform
Law No. 7589 was adopted on 16 July 2026 and published in the Official Gazette of 31 July 2026 (No. 33326). Known as the 12th Judicial Package, it amends civil procedure, enforcement, criminal law, administrative justice, obligations and notarial rules in a single stroke.
The most visible step is the abolition of the action for an uncertain claim. CPC art. 107 is repealed; in a partial action the amount claimed may now be increased once, until the close of the investigation, without the bar on expanding the claim. Limitation is treated as interrupted from the date of the original action even for the increased part. The repealed article continues to apply to actions already brought. Hearings may not, as a rule, be more than three months apart.
On the enforcement side, where an immovable was acquired entirely by inheritance and no third party has a proprietary right, the first auction in a partition by sale is confined to the heir-owners. Guardianship sales move to a UYAP-integrated electronic portal. For HAGB (deferral of the announcement of the verdict) the remedy is now appeal, not objection, and the supervision period is five years. Limited participation in fraud attracts a half-rate reduction. The single-judge threshold in administrative courts rises to TRY 486,000; statutory interest is 80 per cent of the CBRT rediscount rate.
The Civil Code arts. 440 and 444 and CPC art. 149 changes take effect three months after publication; the rest on the publication date. The briefing is below.
