The Competition Authority’s Preliminary Report on the Pharmaceutical Sector

Rekabet Kurumu published its Preliminary Report on the Pharmaceutical Sector Inquiry on 10 August 2026. The inquiry, opened by a Board decision of 8 December 2021, examines the entire medicines supply chain through a competition-law lens — from R&D and patents to marketing authorisation, SGK reimbursement, wholesale distribution and public tenders.

The pricing picture is stark. On 2025 figures, the average pack price of patent-protected medicines was TRY 3,759, against a market average of TRY 164. The Authority continues to treat delayed generic entry as a critical risk to price competition.

Among the Report’s headline themes are pay-for-delay and product-hopping risks, the scope of the Bolar exemption, divisional patent filings, and a fresh look at DMO Sağlık Market and exclusive distribution arrangements.

We have compiled the practical implications and recommendations for originators, generic manufacturers and distribution channels in the briefing note below.
